Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Shopalytics platform, including our website, mobile application, and all related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Shopalytics is a consumer shopping intelligence platform. It aggregates publicly available promotional catalogue information from participating retailers, provides basket-planning tools, and facilitates affiliate tracking with participating retailers. Shopalytics does not sell goods directly.
2. Eligibility
You must be at least 13 years old to use the Service. By using it you confirm this.
Certain features (including viewing liquor promotions) are restricted to users who confirm they are 18 years or older. Providing a false age confirmation is a breach of these Terms and may constitute a violation of applicable Botswana law.
3. Your Account
- You are responsible for keeping your login credentials secure.
- You must notify us immediately at support@shopalytics.co.bw if you suspect unauthorised access.
- You may not share your account or use the Service on behalf of others without their consent.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Scrape, crawl, or systematically extract data without prior written permission.
- Submit false redemption claims or manipulate the affiliate system.
- Introduce malware, perform denial-of-service attacks, or attempt to breach security controls.
- Use the Service to transmit spam, unsolicited messages, or misleading content.
- Reverse-engineer or attempt to extract source code from the Service.
5. Catalogue Data and Accuracy
Catalogue prices and offers are extracted from retailer promotional materials and are provided for informational purposes only. Shopalytics makes no warranty that prices, product availability, or offer validity are accurate, current, or complete.
Always verify prices at the point of sale. Shopalytics is not responsible for any loss arising from reliance on catalogue data.
6. Affiliate and Redemption Programme
Where a 5% affiliate commission is displayed, this reflects our contractual arrangement with a participating retailer and is subject to the terms of that agreement. Commission payments are not guaranteed until a signed retailer affiliate agreement is in place. By submitting a redemption, you confirm the transaction details are accurate.
False or fraudulent redemption submissions may result in immediate account suspension and referral to law enforcement.
7. Intellectual Property
The Shopalytics name, logo, design system, and all original content are owned by Shopalytics and protected by Botswana copyright law. Retailer names, logos, and catalogue images remain the intellectual property of their respective owners and are displayed under fair-use informational principles.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of Liability
To the fullest extent permitted by Botswana law, Shopalytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total aggregate liability shall not exceed BWP 500.
10. Governing Law
These Terms are governed by the laws of the Republic of Botswana. Any dispute shall be subject to the exclusive jurisdiction of the courts of Botswana.
11. Changes to These Terms
We may revise these Terms at any time. We will provide at least 14 days' notice of material changes via an in-app banner or email. Continued use after the effective date constitutes acceptance.
